This page lists the ZONA Software Licensing options, terms, and conditions relating to ZONA's commercial software product line. You can use the links below to jump to any software of interest. To license any of ZONA's software, simply send us a purchase order listing the software, options, target platform, and operating system. A package will be shipped to you containing the software and associated manuals. Specific terms and conditions for each software that may apply to you are listed below. The ASTROS software is currently under development at ZONA Technology. We expect the software to become commercially available in mid 2007. |
The ZONA Nastran Data Loader (ZNDAL) is currently being marketed by Tecplot Inc. as a Tecplot Add-On (for info. please visit www.tecplot.com/products/addons/zona_main.htm). This product is not licensed but can be purchased through Tecplot Inc. at www.tecplot.com/purchase/purchase_zona.htm or through ZONA Technology. Please contact ZONA by telephone or email (ZONA's contact info.) to place an order for this product. Note that a purchase of ZNDAL does not include Tecplot. Tecplot must be purchased separately from Tecplot Inc. |

ZONA's licensed software products utilize a network license manager that is functionally similar to the FLEXlm network license manager. There are typically two types of ZONA software installations that can be made (node-locked or floating). Which installation to choose depends on your usage requirements. The following components are installed for the network license installations:
Note that the installation of Java (ver 1.3.1 or higher) is required for both the Client and Server side license managers (i.e., must be installed on both the server machine and client machines). Java is typically included with the ZONA software CD’s for both the PC and Linux versions. For other Unix versions you must download and install Java for your particular platform. Download and installation instructions can be found at the web sites of Hewlett Packard (HP), Sun Microsystems, IBM, or SGI. If you need assistance to obtain the latest version of Java for your Unix platform, please contact ZONA’s support staff. ZONA Software Installation1. Node-Locked License Installation A Node-Locked License allows a single computer to run the ZONA software. The total number of jobs submitted concurrently on this computer cannot exceed the number of licenses (i.e., tokens) purchased from ZONA. This installation requires that all components (A+B+C+D) be installed on a single machine. 2. Floating License Installation A Floating License allows for the ZONA software to be installed on multiple computers. A Floating License Installation must be performed on each machine on which the software is to be run. The Server License manager (see below) must be installed separately on a single machine (i.e., a server) connected to a network that is accessible by the machines with the Floating License Installations of ZONA's software. This server issues one license (or token) to each computer on the network that submits a job. The total number of jobs submitted concurrently on all computers connected to this server cannot exceed the number of licenses purchased from ZONA for this particular server. Components that are installed under this option are (A+B+D). Note: You will need the Server IP address or domain name (e.g., 123.123.123.3 or mycomputer.com) or machine name (e.g., MY_COMPUTER1) to install this option. Please ask your IT Administrator if you do not have this information available. You will be prompted to input this information during each Floating License installation. However, the IP address can be entered manually at any time after the ZONA software installation is completed by setting the appropriate environment variable. This information is discussed in detail in the documentation provided with the software. Server License Manager InstallationIf Floating License installations are made on a network (#2 above), then this installation option must also be performed on a single designated server connected to this network. The Server License manager issues a license (or token) to each computer on the network that executes a ZONA software job. Components that are installed under this option are (C+D). OBTAINING A LICENSE KEYTo obtain a license key after you have licensed the ZONA software(s) you must fill out the “Point of Contact” information on ZONA’s website (at http://www.zonatech.com/ProductRegistration.htm) and provide the Network Ethernet Address (i.e., physical address such as 00-08-02-5A-90-CD) of the machine onto which the Server License manager is installed. The Network Ethernet Address for a PC/Windows machine can be obtained from opening up an MS-DOS window and typing in [ipconfig /all]. Note that the “Point of Contact” MS-Word document is also included on the ZONA software CD-ROM (called POC.doc) that can be printed, filled in, and emailed or faxed to ZONA (support staff). Once ZONA receives this information, a license key will be sent to you via email. |
The following terms and conditions apply to the licensed ZONA software. By using ZONA's software you agree to the terms and conditions as set forth below.
THE ZSLA IS YOUR PROOF OF LICENSE. THE ZSLA IS A LEGAL AGREEMENT FOR A SINGLE-USER OR FLOATING USER LICENSE OF THE SOFTWARE BETWEEN YOU (EITHER AN INDIVIDUAL OR ENTITY) AND ZONA Technology, Inc. FOR THE PRODUCT IDENTIFIED ABOVE. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT. If you do not agree to the terms of this License Agreement, immediately return the package and/or CDROM. This License Agreement shall apply only if you have not signed another ZONA License Agreement for this software. This software is protected by both United States copyright law and international copyright treaty provisions. SOFTWARE OWNERSHIP ZONA Technology, Inc. has the full ownership of the ZONA software. The software is solely developed by ZONA under its own IRAD support. The title of the ZONA software will remain in ZONA Technology. LICENSE ZONA Technology, Inc. grants you a non-exclusive license to use the software in accordance with the following terms. ZONA Technology, Inc. retains title and all ownership rights to the software. ZONA Technology, Inc. grants you a single-user or floating-user license which allows for installation and use of the software. For single-user (or node-locked) license, installation and usage of the software shall be limited to a single computer. For floating licenses, installation can be made on designated computers provided that ZONA is informed of the number of installations made and Ethernet Addresses and Disk Serial Numbers of said computers. The number of ZONA software job executions that can be made concurrently (for both node-locked and floating license installations) shall be limited to the number of licenses (i.e., tokens) purchased from ZONA. ZONA Technology, Inc. grants you the right to make one (1) archival copy of the software for the sole purpose of backing up the software and protecting your investment from loss. ZONA Technology, Inc. further grants you the right to transfer this license and the software to another party provided: 1) ZONA is informed of the third party and agrees in writing to the license transfer; 2) The other party accepts all terms of this agreement; 3) All copies of the software are transferred and you discontinue use of the software after transferring; 4) ZONA Technology, Inc. is promptly notified of the name and address of the other party and the serial number of the software; and 5) ZONA Technology, Inc. is not required to supply new media. TERM AND TERMINATION Failure to comply with any of these terms will terminate this agreement and your right to use the software. Upon termination of this agreement, you must immediately destroy the software and all copies of it. LIMITED WARRANTY The product will conform to its published specification and the media the software is furnished is warranted to be free of defects in workmanship and material under normal use for a period of sixty (60) days from the date of purchase by you. ZONA Technology, Inc. and its suppliers' sole responsibility and your exclusive remedy under this warranty will be to receive a replacement of the media or a full refund if ZONA Technology, Inc. or its suppliers are unable to deliver media free from defects in workmanship and materials. You alone are responsible for determining which software best meets your particular needs for installing software and for the results obtained. THIS SOFTWARE IS LICENSED "AS IS" WITHOUT WARRANTY AS TO ITS PERFORMANCE. EXCEPT FOR THE MEDIA WARRANTY PROVIDED ABOVE, THERE ARE NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED. IN NO EVENT SHALL ZONA TECHNOLOGY OR ITS SUPPLIERS BE RESPONSIBLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES OR LOST PROFITS, EVEN IF ZONA TECHNOLOGY AND ITS SUPPLIERS HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. SOFTWARE DEVELOPERS If you are developing applications with the software, any individual using your application in conjunction with the software must have purchased their own license of the software. You agree not to use ZONA Technology's name, logo or trademarks to market your application without first receiving ZONA Technology's written permission. You further agree to indemnify, hold harmless, and defend ZONA Technology, and its suppliers from and against any claims or lawsuits that arise or result from the use or distribution of your application. No portion of the software, in whole or in part, may be distributed without the written consent of ZONA Technology. GENERAL If you wish to transfer the software to a new machine and new media is required, you must contact ZONA Technology, Inc. for procedures and possible fees associated with the transfer. You may not copy, sell, sublicense, lease, assign, transfer, disclose, communicate or otherwise the license or the software except as expressly provided in this agreement. Any attempt otherwise to sublicense, assign or transfer any of the rights, duties or obligations hereunder are void. This agreement will be governed by the laws of the State of Arizona. Unless another ZONA Technology, Agreement has been signed for this software, you acknowledge that this agreement supersedes all prior agreements, proposals, representations and communications between the parties relating to the subject matter herein. In the case of conflict between this agreement and purchase orders issued for the software, the terms of this agreement shall prevail. You may return the software only in accordance with the return policy of ZONA Technology, Inc. Contact your ZONA Technology, representative for the proper procedure. U.S. GOVERNMENT RESTRICTED RIGHTS The Software and documentation are provided with Restricted Rights. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1)(ii) and (2) of Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable.
